When you use our services, you trust us with information. As such, we at PodUp Inc. (hereinafter "PodUp") and our affiliates are committed to protecting your privacy. This Privacy Policy applies to the information and data collected by PodUp when you interact with the PodUp Recorder mobile application (the "App"), and/or any other sites or services that link to this Privacy Policy. This Privacy Policy does not apply to content that we process on behalf of customers of our business offerings. Our use of that data is governed by our customer agreements covering access to and use of those offerings.
This Includes When You:
- Download, install and use our App on your mobile device
- Create, record, or publish podcast content through the App
- Interact with us through other channels (for example by communicating with us or attending one of our events)
This page informs you of our policies regarding the collection, use and disclosure of Personal Data when you use our App, and the choices you have associated with that data.
Definitions
Services: Services include the PodUp Recorder App, www.PodUp.com, and all other apps, software, SAAS, and web services offered by PodUp or which reference this Privacy Policy.
Personal Data: Personal Data means data about a living individual who can be identified from such data (or from those and other information either in our possession or likely to come into our possession).
Usage Data: Usage Data is data collected automatically either generated by the use of the App, use of PodUp Services, your communications with PodUp, surveys and events, or from the Services infrastructure itself (for example, the duration of a recording session or app usage patterns), including your communications, inputs to our Services (i.e. prompts and other content you upload in any form, including but not limited to files, audio, video, and/or picture, depending on the features you use).
Device Data: Device Data includes information about your mobile device such as device type, operating system, unique device identifiers, and mobile network information.
Recording Data: Recording Data includes audio recordings, video recordings (if applicable), transcripts, and any content you create through the App.
What Data We Collect Through the App
When you download, install, or use the PodUp Recorder App, we collect the following types of information:
Account Information
When you use our App, we may collect certain information that can be used to contact or identify you. This includes:
- Email address
- First name and last name
- Profile picture (if provided)
- Login credentials
Cookies and Similar Technologies: We use cookies and similar technologies to operate and administer our Services, and improve your experience. If you use our Services without creating an account, we may still store some of the information described in our cookies policies, for example to help maintain your preferences across browsing sessions.
Note: The App currently uses an “Update Details” feature rather than a traditional signup process.
Recording and Content Data
When you use the recording features of our App, we collect:
- Audio recordings you create through the App
- Video recordings (if you enable video recording features)
- Podcast episodes you upload or record
- Transcripts generated from your audio content
- Show notes, titles, and descriptions you create
- Metadata associated with your recordings (duration, date, file size, etc.)
Device and Technical Data
We automatically collect certain information when you use the App:
- Device type, model, and manufacturer
- Operating system and version
- Unique device identifiers (such as IDFA for iOS or Advertising ID for Android)
- IP address and approximate location (city/region level)
- App version and build number
- Crash logs and performance data
- Browser type and version (when accessing web features)
- Time zone and language settings
App Permissions and Access
The PodUp Recorder App requests the following permissions on your device. You can manage these permissions through your device settings at any time:
- Microphone Access: Required to record audio for your podcasts. The App only accesses your microphone when you initiate a recording session, granting permission to do so.
- Camera Access: Required when you record video content or set a profile picture.
- Storage Access: Required to save recordings locally on your device and to upload/download content.
- Push Notification: Used to send you updates about the App, your recordings, publishing status, and service announcements.
- Intent Access: Required for downloading the App, App usage, uploading recordings, syncing content, and accessing cloud features.
Why We Collect Your Data
We use the data we collect for the following purposes:

- Encryption at Rest: Your recordings and personal data are stored using encryption on our secure cloud servers.
- Access Controls: We limit access to your data to authorized personnel who need it to provide our services.
- Regular Security Audits: We conduct regular security reviews and monitoring to identify and address vulnerabilities.
- Secure Authentication: We use secure authentication methods to protect your account access.
While we implement these protections, please be aware that no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee the absolute security of your Personal Data.
AI-Powered Features
The PodUp Recorder App includes AI-powered features to enhance your podcasting experience, including transcription, content suggestions, and audio processing. When you use these features:
- Your audio content may be processed by our AI systems or authorized third party AI service providers.
- We process your content solely to provide the requested AI features and improve our services.
- You retain ownership of all content you create.
- You may opt out of certain AI features through your App settings
Data Retention and Usage
We retain and use your Personal Data and recordings for as long as necessary to provide our Services and fulfill the purposes described in this Privacy Policy, such as:
- Recordings: You may delete your recordings at any time through the App.
- Backup Data: May be retained in secure backups for a limited period after deletion for disaster recovery purposes. PodUp does not guarantee your data will be backed up for any purposes.
- Usage Data: Generally retained for a shorter period for internal analysis.
- Account Data: Retained while your account is active and for a reasonable period afterward to comply with legal obligations.
- To provide, analyze, and maintain our Services, for example to respond to your questions.
- To improve and develop our Services and conduct research, for example to develop new product features.
- To communicate with you, including to send you information about our Services and events.
- To prevent fraud, illegal activity, or misuses of our Services, and to protect the security of our systems and Services.
- To comply with legal obligations and to protect the rights, privacy, safety, or property of our users and/or other third parties.
We may also aggregate or de-identify Data so that it no longer identifies you and use this such information for the purposes described above, such as to analyze the way our Services are being used, to improve and add features, and/or to conduct research. PodUp will maintain and use de-identified information in de-identified form and not attempt to reidentify the information, unless required by law. As noted above, we may use our interactions with you in all forms to improve our Services, for example to train the models that power our AI, which you may opt out of in the App.
Third-Party Services and Integrations
The App may integrate with third-party services. When you connect third-party accounts or use integrations:
- We may access certain information from those services as authorized by you
- Third-party services are governed by their own privacy policies
- You can disconnect third-party integrations at any time through the App settings
Your Rights and Controls
You have control over your data. Through the App and your device settings, you can:
- Manage Permissions: Revoke microphone, camera, or storage permissions through your device settings at any time.
- Delete Content: Delete your recordings and content from within the App.
- Access Your Data: Request a copy of the personal data we hold about you when required by law.
- Correct Your Data: Update or correct your account information through the App.
- Delete Your Account: Request account deletion by contacting support@PodUp.com.
- Opt-Out of Notifications: Disable push notifications through your device settings.
- Opt-Out of Marketing: Unsubscribe from marketing emails by following the unsubscribe link or contacting us.
Your Rights Under the CCPA (California Residents)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):
- Right to Delete: You have the right to request deletion of your Personal Data, subject to certain exceptions.
- Right to Opt-Out: You have the right to opt out of the sale of your Personal Data. At present, PodUp does not sell Personal Data and does not have plans to do so in the foreseeable future.
- Right to Non-Discrimination: You have the right not to be discriminated against for exercising your privacy rights.
- Right to Know: You have the right to request information about the categories and specific pieces of Personal Data we have collected about you.

Your Rights Under the VCDPA (Virginia Residents)
If you are a Virginia resident, you have the following rights under the Virginia Consumer Data Protection Act (VCDPA):
- Right to confirm whether we are processing your Personal Data and to access such data
- Right to correct inaccuracies in your Personal Data
- Right to delete your Personal Data
- Right to obtain a portable copy of your Personal Data
- Right to opt out of targeted advertising, sale of Personal Data, or profiling

AI Accuracy
AI services, such as those provided by PodUp generate responses by reading a user’s request and, in response, predicting the word(s) most likely to appear and/or respond to the request. In some cases, the word(s) or responses may not be factually accurate. For this reason, you should not rely on the factual accuracy of output from our models. If you notice that our AI outputs contain factually inaccurate information about you and you would like to request a correction or removal of the information, you can submit these requests to support@PodUp.com and we will consider your request based on applicable law and the technical capabilities of our models.
Children’s Privacy
Our App and Services are not directed to anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us at support@PodUp.com. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take steps to remove that information from our servers.
Updates to This Privacy Policy
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top of this Privacy Policy. If the changes are material, we will attempt to provide a more prominent notice by sending you an email notification or through a notification in the App. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
Locations
Neither PodUp Services nor the PodUp App are intended for use outside the United States of America. By using our services and/or the App, you attest that you are located within the United States.
